Understanding uninsured motorist coverage

On Behalf of Law Office of Richard J. Presutti, P.C. | Jun 1, 2023 | Car Accidents

If a driver is in an accident with another driver, it’s easy to assume that they’ll both stop and exchange insurance information. However, if one of the drivers is an uninsured motorist, it can be more complicated.

Uninsured motorist coverage

In Texas, all drivers are required to carry liability insurance to cover the damage they cause to property and other drivers. Unfortunately, some drivers neglect this requirement and drive without insurance.

If a driver is involved in an accident with an uninsured motorist, they may be able to receive compensation through their insurance policy, depending on their coverage.

Car insurance policies sold in the state include optional uninsured motorist coverage that is selected when the driver buys a policy. It protects a driver if they are in an accident caused by a driver who does not have insurance or does not have enough insurance to cover the damage they cause.

The claim is paid by the insured driver’s insurance company. It usually covers medical bills, lost wages, pain and suffering and other expenses, up to the limits of the insured driver’s policy. It can also cover damage to the insured driver’s vehicle or other property.

No coverage

If the driver does not have uninsured motorist coverage, they may still be able to recover compensation by filing a lawsuit against the uninsured driver. However, it may be more difficult to collect damages from an uninsured driver if they do not have the money to pay a judgment.

Vehicle accidents can cause serious injuries and long-lasting financial impact on drivers, who need time and resources to recover.
